Dan Ciobanu, Partener Suciu Popa: Proiectele din energia fotovoltaica au un pas de dezvoltare si de finalizare mult mai alert decat cele din energia clasica. Exista o oarecare bariera a autorizatiilor pentru investitori

“Din ce am vazut pana in acest moment, energia regenerabila, energia fotovoltaica are un pas de dezvoltare, de punere in practica si de finalizare mult mai alert decat energia clasica. Intr-adevar Romgaz continua dezvoltarea, ramane de vazut cand vom vedea primele molecule de gaz in retea, dar in ceea ce am vazut noi ca vorbim totusi de mult mai multi investitori, unii lucreaza cu fonduri proprii, vedem o anumita efervescenta si din ceea ce simtim noi vor vedea lumina zilei mai multe astfel de proiecte decat cele din resursa clasica“, a declarat Dan Ciobanu, Partener in cadrul casei de avocatura Suciu Popa la THE SUSTAINABILITY CHALLENGE 2022, eveniment organizat pe 25 octombrie de catre jurnalul de tranzactii MIRSANU.RO.

“Vedem mari jucatori cum este cazul Complexului Energetic Oltenia, care produce energie electrica din surse clasice precum carbune sau pacura. Am vazut in presa recent ca a inceput un parteneriat cu Petrom ca sa dezvolte 4 proiecte de energie regenerabila in valoare de 450 MW putere instalata. Intr-adevar in planul national integrat in domeniul energiei, Romania si-a asumat ca pana la finalul anului 2030 va avea o pondere de 30,7% din energia electrica consumata obtinuta din surse regenerabile. Declaratiile decidentilor politici mentioneaza chiar o pondere de 34%. Vorbim de circa 6 GW instalati in energie electrica din surse regenerabile raportat la anul 2015.“, adauga avocatul Suciu Popa.

“In ultimii 3 ani, observam aceasta efervescenta in energia regenerabila. Asistam clienti, inclusiv Econergy, intr-o multitudine de proiecte. Din informatiile publice pe care le avem si noi la acest moment sunt in diverse etape de avizare, avize tehnice de racordare cu putere instalata de 30 GW, trebuie vazut cati din acesti GW se vor transforma in proiecte construite care vor pompa efectiv energie in retea“, precizeaza Dan Ciobanu.

“Din punct de vedere strict juridic, desi avem un cadru european bine stabilit inca suntem un pic un urma cu implementarea unor recomandari ale Comisiei si Uniunii Europene vizavi de modul in care ar trebui sa se raporteze autoritatile la investitori. Am vazut o usoare deschidere ca se intentioneaza sa se incurajeze proiectele dezvoltate pe o suprafata de maximum 50 de hectare insemnand ca nu va mai avea nevoie de un plan urbanistic zonal. Uneori, in practica, din experienta noastra, autoritatile interpreteaza in maniera proprie, aceste facilitati care au fost gandite si adoptate prin diverse ordonante ale guvernului“, a mai spus avocatul Suciu Popa.

“Exista o oarecare bariera a autorizatiilor uneori.  Ramane de vazut, de asemenea, cate din acest proiecte se vor transforma in realitate in contextul in care au inceput deja sa vedem avize tehnice de racordare cu data de punere in functiune 2028 – 2030 ceea ce inseamna ca, desi operatorii de transport si distributie incearca sa se dezvolte si sa le intareasca pe cele existente, in practica nu e atat de usor de facut. Au nevoie de fonduri, cand e vorba de Transelectrica, operatorul de transport fiind reteaua statului se complica un pic lucrurile, spre deosebire de distribuitori care sunt aproape in integime privati si atunci sunt diferite provocari in piata pe care le vedem si incercam sa ne asistam clientii astfel incat sa treaca peste astfel de provocari sa vedem cat mai multe proiecte puse in functiune“, a mai spus Dan Ciobanu, Partener in cadrul casei de avocatura Suciu Popa in cadrul panelului de industrie si energie al evenimentului THE SUSTAINABILITY CHALLENGE 2022.
